Terms and conditions of sale

Article 1 - Purpose

These terms and conditions of sale govern sales made on the bloomxblaze.com website. Placing an order implies acceptance of these terms and conditions.

Article 3 - Products

Bloom × Blaze offers the products presented on the website for sale.

The essential characteristics of the products are presented on the website before an order is placed. The photographs and visuals are intended to represent the products offered as accurately as possible. Slight variations in shade, colour or texture may nevertheless occur, particularly because of the nature of the materials used and the conditions in which the photographs are taken.

Article 4 - Availability

Products are offered subject to availability. If a product becomes unavailable after an order has been placed, the customer will be informed as soon as possible. If the order cannot be fulfilled, the sums paid will be refunded.

Article 5 - Prices

Prices are shown in euros, with no VAT charged (VAT not applicable, article 56bis of the VAT Code). Delivery costs are shown before the order is confirmed.

Except in the case of an obvious error, the applicable price is the one displayed when the order is confirmed.

Article 6 - Orders

The customer selects the products they want, provides the information required for the order, checks the order summary, and then confirms payment.

The order becomes final once payment has been confirmed and a summary email has been sent.

Article 7 - Payment

Payment is secure and is made through Stripe and PayPal, using the options available when the order is placed. Depending on the circumstances, payment may be available by card (Visa, Mastercard), Bancontact, PayPal, Apple Pay and Google Pay, or any other method displayed when the order is placed.

Payment data is processed by the payment service providers and is not stored by Bloom × Blaze.

Article 8 - Delivery

Delivery terms are detailed on the Delivery & returns page.

The overall delivery time, including preparation, dispatch and transport, depends on the country of delivery: it is shown for each country on the Delivery & returns page, excluding weekends and public holidays. Unless another period has been expressly agreed, the order is delivered no later than 30 days after the conclusion of the contract.

Article 9 - Right of withdrawal

As a rule, the consumer has 14 calendar days from the day after receiving the goods to exercise the right of withdrawal, without having to give a reason.

Article 10 - Refunds

In the event of a valid withdrawal, the refund will be made in accordance with the applicable regulations and as set out on the Return and refund policy page.

Article 11 - Statutory guarantees

All products sold benefit from the following statutory guarantees, independently of any right of withdrawal that may apply:

  • Statutory guarantee of conformity — duration of 2 years from delivery of the goods. This guarantee applies under Belgian law (articles 1649bis to 1649octies of the Belgian Civil Code) and under French law for consumers residing in France (articles L217-3 to L217-17 of the French Consumer Code).
  • Guarantee against hidden defects — applicable under Belgian law (articles 1641 to 1649 of the Belgian Civil Code) and under French law for consumers residing in France (articles 1641 to 1649 of the French Civil Code). It allows the consumer to seek termination of the sale or a reduction in the price within 2 years of discovering the defect.

To exercise these guarantees, contact us at contact@bloomxblaze.com with your order number and a description of the defect observed. We cannot be held liable under a guarantee if the issue results from use that does not comply with the product’s intended purpose.

Article 12 - Liability

Bloom × Blaze cannot be held liable for failure to perform or improper performance of the contract in the event of fault by the customer, an unforeseeable and insurmountable act by a third party, or force majeure within the meaning of the law.

Article 13 - Mediation

In the event of a dispute, the customer is invited to contact Bloom × Blaze first to seek an amicable solution.

Article 14 - Applicable law and competent jurisdiction

These terms and conditions of sale are governed by Belgian law.

Pursuant to article 6 of Regulation (EC) No 593/2008 ("Rome I"), a consumer residing in another Member State of the European Union (in particular France) retains the benefit of the mandatory protective provisions provided for by the law of their country of habitual residence. These provisions cannot be excluded by contractual agreement.

Any dispute will be brought before the competent courts in accordance with the applicable rules. Pursuant to articles 17 to 19 of Regulation (EU) No 1215/2012 ("Brussels I Recast"), the consumer retains the right to bring a claim before the court of their place of habitual residence or the court of the place where the contract is performed.
